Refugee & Asylum Protection

If you or your family member has been the victim of torture or persecution in your home country, or have good reason to believe that you would be if you were forced to return, you may be eligible for asylum or refugee protection in Canada under the Immigration & Refugee Protection Act (IRPA).

If needed, we can help establish your eligibility to file a refugee claim. However, at this time we do not prepare refugee and asylum cases.

We will conduct a thorough initial consultation to determine if it appears that your case would have merit (in the eyes of Citizenship Immigration Canada). If so, we will refer you to one of two ethical refugee specialists in Canada.

If located in the United States, our consultation will also assess if the refugee applicant can qualify for an exemption under the Third-Country Agreement. (US-based applicants are generally prohibited from filing a refugee claim in Canada under an agreement negotiated with the United States.)

Deliverables for a Refugee and Asylum Consultation:

  • Does the Client have a valid refugee or asylum claim?
  • If the Client is located in the United States and wishes to file a refugee claim, does he qualify for an exemption under the Third Country Agreement?
  • What is the probability of a successful outcome?
  • Referral service (if the firm believes that a successful outcome is likely)
